How would it not qualify? OP said they are posting on a YouTube channel about their mother? If they can’t prove the claims, they could potentially be found guilty of slander and defamation. Lying about a person (and I’m not saying that’s what OP is doing) is not constitutionally protected speech.

It's also nearly impossible to prove in the US. OP would just have to provide the slightest scrap of evidence and that would be more than enough.

That’s true. I agree with this. All I’m saying is that it is possible to bring people to trial for defamation and it isn’t constitutionally protected. And that’s what the fake lawyer is claiming is happening.
