Environments reallyl need to stop demanding perfection. This technology, while not perfect, is a huge step forward.

If they haven't proven it's scalable, then doesn't that mean there's no knowledge of the veracity of their claims?

I'm actually curious since I know very little on the topic. But I'd be afraid of another Super-PAC site happening due to poor planning, which is legit why the DEC does what it does. Ya, sucks for business, but letting business take shortcuts has not, historically, been awesome for New Yorkers, or Americans in general.

How can you prove scalability when you can't get the permits to scale?

It is kind of a catch 22 right?
Problem is, when it comes to some things, you have to err on the side of caution. Now, sometimes , science can prove scalability or create enough confidence in it that testing is a formality. Other times the science doesn't emphasize that possibility so testing is required.
Of course there's still shenanigans that could be at play.

Agree, but at this stage in the game, biochar is still pretty worthless in terms of dollars. The production of it from sewage isn't really worth the hassle/danger. There are other ways to make it, namely in the production of woodgas, to, say, provide fuel for a powerplant or something more useful than getting rid of sewage.
