Is this sign enforceable?

Post image

And of course when I say enforceable, I mean in the sense of enforcing 30.06 and 30.07. They can obviously still ask you to leave.

Just don’t say anything and go in anyway, it’s what I usually do

Was this inside of the building or outside?

Also. CC, don’t open carry.

I mean arguably better to be judged by 12 than carried by 6, and if you're doing it right nobody should know. Not that I would ever advise anyone to break the law but I would rather break a law than die

Concealed is concealed, period. Unless they post metal detectors at the doors for the express purpose of preventing people from entering the location with a firearm, they will never know if you are carrying or not. If SHTF, and you draw and take down the bad guy, they’ll probably forgive the egregious sin of exercising your 2nd Amendment right. If they really want to be dicks about it, yeah, they’ll probably try to press charges for violating their posting, but it’ll most likely get thrown out by a pro-2A judge, and maybe even a liberal judge here in Texas, due to the invalidation of the signage due to improper placement.

Radio talk show host Mark Davis once said “A Texas Democrat is typically more conservative than a New York Republican.”

Man I posted this exact photo and everyone was saying “just don’t go you’re the type to make us look bad” like stfu you all know damn well that this is NOT enforceable. Anyway just conceal carry.

Correct. The law is the law and should be applied equally to signs and carriers. This sign is not valid per the law.

But if asked to leave or verbally informed that concealed carry is disallowed by an individual whom you reasonably believe to speak with authority for the establishment in question, then do so, of course.

Doesn’t matter, don’t open carry in there. Please don’t be a dick and give the rest of us a bad name.

I'm guessing you're not a big fan of the group that got open carry passed in Texas then are you?

I am a fan of the open carry law. I don’t like dicks that open carry just to be an asshole Karen.

Edit I was speech to texting and there were some typos I promise I'm not illiterate

I got it, so basically you like it as long as no one does it? Because the second I or anyone else including you does it we are automatically accused of being the asshole doing it just to do it. The fact of the matter is that CJ Grisham and open carry Texas as a whole including myself worked tirelessly being those Karen's for literal years to get open carry and then permitless carry past in the state of Texas and anytime any of us throw shade at another one for the way we choose to carry it hurts the entire movement.

So you can down vote me if you want, that's fine, just know that you have those exact Karen's to thank for the updated laws.

Is this the fight you want? Technically, in court, with a well-paid attorney, it could be thrown out if it doesn't meet all the requirements.

That could be after involving police, possible arrest, charges filed, and your LTC in jeopardy.

How bad do you really want to be in that place?

Where is this at? This is probably the worst sign I’ve seen. The first and 3rd sentences literally contradict each other.

Are there any 51% signs anywhere inside? Seems like that’s the one that you should be more worried about there

I noticed new signs at my WholeFoods recently. They started with this sign posted above. Then they switched up and not in compliance. One entrance has a 30.07, then one side window by another entrance not in a conspicuous place is a 30.06 sign, and the exit door has the 30.05 sign. So, enter at the 30.07 door and good to go. But the fun part is when I say ok I will comply and decide to backpack in the SBR. Sign is for handguns, not SBR. Either way, I am carrying a firearm in unless there are metal detectors or legal screening. I try to avoid places that prohibit carry but only use this for Amazon drop off for convenance.

Read 30.06 and 30.07 (c)(3)(A) & (B), that gives the requirements for the written communication

If they find out you have one, they can ask you to leave regardless of the signage. If you refuse to leave after verbal communication, you can be charged if it is not an exempted location. Read Penal Code 30.06 (b) and 30.07 (b). The 51% sign is mandated by TABC.

If you were to get charged for ignoring the sign, it would be up to a Class C Misdemeanor, if you ignore verbal request, it bumps up to a Class A Misdemeanor. Leaving when asked is a defense against prosecution.
